AxeMiner, LLC – Terms and Conditions of Sale and Service
1. No Guarantee of Hashrate Performance
    • Variable Performance: AxeMiner, LLC provides hardware specified with an estimated baseline hashrate. You explicitly acknowledge that the actual running hashrate of the device may fluctuate based on environmental factors, power stability, network configuration, local Wi-Fi connectivity, thermal conditions, and silicon lotteries.
    • No Performance Warranties: AxeMiner, LLC does not warrant or guarantee that the device will continuously perform at its peak stated or advertised hashrate during daily operation.

2. Financial and Investment Disclaimer (No ROI or Profit Guarantee)
    • High-Risk Activity: Cryptocurrency mining is an inherently volatile, competitive, and speculative activity. Solo mining functions similarly to a probabilistic lottery with extremely low mathematical odds of independently finding a valid block.
    • No Guaranteed Returns: AxeMiner, LLC explicitly disclaims any representations, warranties, or forecasts regarding financial gain, profits, income generation, or Return on Investment (ROI).
    • Assumption of Risk: The purchaser assumes all financial risks associated with the cost of energy, hardware depreciation, and shifting network difficulty parameters.

3. Limitation of Liability and Mining Pool Operational Risks
  • Independent Infrastructure: While AxeMiner, LLC hardware can be configured to connect directly to our affiliated public mining pool infrastructure, found at AxeMiner Pool, the purchase of the hardware does not guarantee uninterrupted pool connectivity. [1]
  • Service Interruptions: AxeMiner, LLC shall not be held responsible, liable, or accountable for any losses, missed block opportunities, unsubmitted shares, or downtime resulting from AxeMiner Pool going out of service, undergoing maintenance, suffering cyberattacks, or experiencing sudden network disruptions.   • Alternative Routing: The user retains the capability and responsibility to configure their device to redirect their hardware’s hashing power to any alternative third-party Stratum-compatible mining pool in the event of an outage.
4. Intellectual Property
  • 4.1 Proprietary Assets and Trademarks
    All right, title, and interest in and to the physical hardware design, custom casings, website text, marketing assets, and the domain axeminer.ai and Axeminer.com are the exclusive intellectual property of AxeMiner, LLC. The names and logos for AxeMiner, Axarray, TrueHash, TempSense, AxeAtlas, FleetSense, and ZenMode are proprietary commercial trademarks. Purchase of the hardware does not transfer any ownership or license rights to these brand assets.
  • 4.2 Software Components
    The hardware firmware incorporates software components governed by third-party licensing terms. For mandatory code attributions, license texts, and source code repository access instructions, please review our official AxeMiner Software Component Disclosure Page.
  • 4.3 Trademark Exception
    Pursuant to Section 7(e) of the GNU GPLv3, no permission is granted under trademark law to use any of AxeMiner LLC’s trade names, trademarks, service marks, or logos, including AxeMiner, Axarray, TrueHash, TempSense, AxeAtlas, FleetSense, and ZenMode, except where otherwise permitted by applicable law. This term does not limit any permission granted under the GNU GPL.
  • 4.4 Firmware Modification and Hardware Warranties
    While the GPL-3.0 protects your right to modify and re-flash the firmware on your device, doing so alters the physical operations of the machine. Any component damage, thermal degradation, or hardware bricking caused by installing unofficial, unverified, or custom modified firmware will completely void the physical hardware warranty. All software is provided “AS IS” without warranty of any kind.
